Football Leaks: The New Data Protection Code

When Football Leaks first came out with its contents, the initial suggestion was that it would be an enormous embarrassment to FIFA that their documents were so easily accessible online to anyone.

While Leaks is often heralded as a game-changer for the sport, and was expected to change the game and revolutionise football in the process, it also highlighted a potential issue which many, it seemed, did not want to face – namely, the security of data.

This has been addressed somewhat with the introduction of the new Football Leaks data protection code, which is in place until 2020.

The code, which was brought in following the initial reports of the leak, was made by the International Football Association Board, and was designed to make sure that the information that was leaked would not be used in the wrong way by the people who made the decisions, and to create procedures and checks to make sure that they do not leak information when they have access to it.

However, with the arrival of Leaks two years ago, it appears that a new issue has emerged, where the data protection is set to be completely thrown out.

That is, it seems that those who have received that data – and thus those in power in football – are set to have full access to the data, and that the security measures are meaningless.

It has been pointed out that the FA is no longer in a position to dictate the rules on football – and this is the issue that the new code is designed to address.

The code states that the data will only be used as long as the original author is still in a position to decide to do so.

If however, it is no longer used, then the data will never be used, unless the FA decide to use it. This is likely to be the case, as the new FA chief executive, Martin Glenn, recently stated that he saw no interest in the data.

“The potential for unbridled use was never an issue, since there was no clear definition of the data,” Glenn told the FT.

“The only issue was whether this data should be used in our own internal processes.”
